1. Agreement to Terms

By accessing or using TuRaite's mobile application, website, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

These Terms constitute a legally binding agreement between you and TuRaite. Please read them carefully.

2. Service Description

Important: TuRaite is a technology platform that connects riders with drivers who offer ridesharing services. TuRaite does not provide transportation services and is not a transportation carrier. All transportation services are provided by independent drivers who are not employees or agents of TuRaite.

TuRaite provides a platform that enables:

  • Riders to find and request rides from drivers with compatible routes
  • Drivers to offer available seats on their recurring commutes
  • Direct communication between riders and drivers
  • Route matching based on pickup/dropoff locations and schedules

3. Eligibility

To use TuRaite, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable law
  • Provide accurate and complete registration information

4. User Accounts

4.1 Account Creation

You must create an account to use certain features of the Service. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your account credentials secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4.2 Account Termination

You may delete your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.

5. Driver Requirements

To offer rides as a driver on TuRaite, you must:

  • Hold a valid driver's license for your jurisdiction
  • Be at least 18 years of age
  • Have a vehicle that is properly registered, insured, and in safe operating condition
  • Maintain valid auto insurance that covers ridesharing activities
  • Pass any verification requirements we implement
  • Comply with all applicable local, state, and federal laws

Drivers are independent contractors, not employees of TuRaite. Drivers set their own routes, schedules, and prices.

6. Rider Responsibilities

As a rider, you agree to:

  • Provide accurate pickup and dropoff locations
  • Be ready at the agreed pickup time and location
  • Treat drivers with respect and courtesy
  • Pay the agreed fare in cash directly to the driver
  • Follow any reasonable instructions from the driver
  • Not engage in any illegal, harmful, or disruptive behavior
  • Wear seatbelts as required by law

7. Payments

7.1 Cash Payments

All ride payments are made in cash directly between riders and drivers. TuRaite does not process payments and does not take any commission or fees from ride fares.

7.2 Pricing

Drivers independently set their own prices for rides. Prices are displayed before you request a ride. By requesting a ride, you agree to pay the displayed price.

7.3 Disputes

Payment disputes between riders and drivers should be resolved directly between the parties. TuRaite may, at its discretion, assist in mediation but is not responsible for resolving payment disputes.

8. Points Program

TuRaite may award points to users for certain activities within the App, such as completing rides or giving ratings.

  • Points are a voluntary feature and have no monetary or cash value
  • Points cannot be exchanged, transferred, sold, or redeemed for cash, goods, or services
  • TuRaite reserves the right to modify, suspend, or discontinue the points program at any time without notice
  • TuRaite may adjust, reset, or revoke points at its discretion, including in cases of abuse or violation of these Terms
  • Points balances do not constitute property, stored value, or any form of credit

9. User Conduct

You agree not to:

  • Use the Service for any illegal purpose
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Provide false or misleading information
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service while under the influence of alcohol or drugs
  • Carry weapons, illegal substances, or hazardous materials
  • Discriminate against other users based on race, religion, gender, sexual orientation, disability, or any other protected characteristic

10. Safety

While we strive to maintain a safe community, TuRaite cannot guarantee the safety of any ride. Users are encouraged to:

  • Review driver/rider profiles and ratings before accepting rides
  • Share ride details with friends or family
  • Trust your instincts - if something feels wrong, don't take the ride
  • Report any safety concerns immediately

11. Ratings and Reviews

After each ride, riders and drivers may rate and review each other. By using the Service, you agree that:

  • Your ratings and reviews will be visible to other users
  • You will provide honest and accurate ratings
  • TuRaite may remove reviews that violate our policies
  • Low ratings may result in account restrictions or termination

12. Intellectual Property

The TuRaite name, logo, and all related content are owned by TuRaite and protected by intellectual property laws. You may not use our intellectual property without prior written permission.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TuRaite disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

TuRaite does not warrant that:

  • The Service will be uninterrupted or error-free
  • Drivers will be available in your area
  • Any user information is accurate or truthful
  • The Service will meet your specific requirements

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURAITE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or goodwill
  • Any damages resulting from the conduct of drivers or riders
  • Any accidents, injuries, or property damage that occur during rides
  • Any disputes between users

Our total liability for any claim arising from the Service shall not exceed $100.

15. Indemnification

You agree to indemnify and hold harmless TuRaite and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

16. Dispute Resolution

16.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at [email protected] to attempt to resolve the dispute informally.

16.2 Arbitration

Any disputes that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Joaquin County, California.

16.3 Class Action Waiver

You agree to resolve disputes with TuRaite on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

17. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.

18. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.

19. General Provisions

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Failure to enforce any right or provision does not constitute a waiver.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
  • Entire Agreement: These Terms constitute the entire agreement between you and TuRaite.

3. Elegibilidad

Para usar TuRaite, debes:

  • Proporcionar información de registro precisa y completa

4. Cuentas de Usuario

4.1 Creación de Cuenta

Debes crear una cuenta para usar ciertas funciones del Servicio. Aceptas:

  • Proporcionar información precisa, actual y completa
  • Mantener y actualizar prontamente la información de tu cuenta
  • Mantener tus credenciales de cuenta seguras y confidenciales
  • Aceptar responsabilidad por todas las actividades bajo tu cuenta
  • Notificarnos inmediatamente de cualquier uso no autorizado

4.2 Terminación de Cuenta

Puedes eliminar tu cuenta en cualquier momento. Nos reservamos el derecho de suspender o terminar cuentas que violen estos Términos o por cualquier otra razón a nuestra discreción.

5. Requisitos para Conductores

Para ofrecer viajes como conductor en TuRaite, debes:

  • Tener una licencia de conducir válida para tu jurisdicción
  • Tener al menos 18 años de edad
  • Tener un vehículo debidamente registrado, asegurado y en condiciones seguras de operación
  • Mantener un seguro de auto válido que cubra actividades de viajes compartidos
  • Pasar cualquier requisito de verificación que implementemos
  • Cumplir con todas las leyes locales, estatales y federales aplicables

Los conductores son contratistas independientes, no empleados de TuRaite. Los conductores establecen sus propias rutas, horarios y precios.

6. Responsabilidades del Pasajero

Como pasajero, aceptas:

  • Proporcionar ubicaciones precisas de recogida y destino
  • Estar listo en el horario y ubicación acordados
  • Tratar a los conductores con respeto y cortesía
  • Pagar la tarifa acordada en efectivo directamente al conductor
  • Seguir cualquier instrucción razonable del conductor
  • No participar en ningún comportamiento ilegal, dañino o disruptivo
  • Usar cinturones de seguridad según lo requiera la ley

7. Pagos

7.1 Pagos en Efectivo

Todos los pagos de viajes se realizan en efectivo directamente entre pasajeros y conductores. TuRaite no procesa pagos y no cobra ninguna comisión o tarifa de las tarifas de viaje.

7.2 Precios

Los conductores establecen independientemente sus propios precios para los viajes. Los precios se muestran antes de solicitar un viaje. Al solicitar un viaje, aceptas pagar el precio mostrado.

7.3 Disputas

Las disputas de pago entre pasajeros y conductores deben resolverse directamente entre las partes. TuRaite puede, a su discreción, asistir en la mediación pero no es responsable de resolver disputas de pago.

8. Programa de Puntos

TuRaite puede otorgar puntos a los usuarios por ciertas actividades dentro de la App, como completar viajes o dar calificaciones.

  • Los puntos son una función voluntaria y no tienen valor monetario ni en efectivo
  • Los puntos no pueden intercambiarse, transferirse, venderse ni canjearse por efectivo, bienes o servicios
  • TuRaite se reserva el derecho de modificar, suspender o descontinuar el programa de puntos en cualquier momento sin previo aviso
  • TuRaite puede ajustar, restablecer o revocar puntos a su discreción, incluyendo en casos de abuso o violación de estos Términos
  • Los saldos de puntos no constituyen propiedad, valor almacenado ni ninguna forma de crédito

9. Conducta del Usuario

Aceptas no:

  • Usar el Servicio para cualquier propósito ilegal
  • Acosar, abusar o dañar a otros usuarios
  • Suplantar a cualquier persona o entidad
  • Proporcionar información falsa o engañosa
  • Interferir o interrumpir el Servicio
  • Intentar obtener acceso no autorizado a cualquier parte del Servicio
  • Usar el Servicio bajo la influencia de alcohol o drogas
  • Transportar armas, sustancias ilegales o materiales peligrosos
  • Discriminar a otros usuarios por raza, religión, género, orientación sexual, discapacidad o cualquier otra característica protegida

10. Seguridad

Aunque nos esforzamos por mantener una comunidad segura, TuRaite no puede garantizar la seguridad de ningún viaje. Se alienta a los usuarios a:

  • Revisar perfiles y calificaciones de conductores/pasajeros antes de aceptar viajes
  • Compartir detalles del viaje con amigos o familiares
  • Confiar en sus instintos - si algo se siente mal, no tomes el viaje
  • Reportar cualquier preocupación de seguridad inmediatamente

11. Calificaciones y Reseñas

Después de cada viaje, pasajeros y conductores pueden calificarse y evaluarse mutuamente. Al usar el Servicio, aceptas que:

  • Tus calificaciones y reseñas serán visibles para otros usuarios
  • Proporcionarás calificaciones honestas y precisas
  • TuRaite puede eliminar reseñas que violen nuestras políticas
  • Calificaciones bajas pueden resultar en restricciones o terminación de cuenta

12. Propiedad Intelectual

El nombre TuRaite, logo y todo el contenido relacionado son propiedad de TuRaite y están protegidos por leyes de propiedad intelectual. No puedes usar nuestra propiedad intelectual sin permiso previo por escrito.

13. Descargo de Responsabilidad

EL SERVICIO SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD" SIN GARANTÍAS DE NINGÚN TIPO. TuRaite rechaza todas las garantías, expresas o implícitas, incluyendo garantías de comerciabilidad, idoneidad para un propósito particular y no infracción.

TuRaite no garantiza que:

  • El Servicio será ininterrumpido o libre de errores
  • Los conductores estarán disponibles en tu área
  • Cualquier información de usuario sea precisa o veraz
  • El Servicio cumplirá con tus requisitos específicos

14. Limitación de Responsabilidad

EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, TURAITE NO SERÁ RESPONSABLE POR:

  • Cualquier daño indirecto, incidental, especial, consecuente o punitivo
  • Cualquier pérdida de ganancias, ingresos, datos o buena voluntad
  • Cualquier daño resultante de la conducta de conductores o pasajeros
  • Cualquier accidente, lesión o daño a la propiedad que ocurra durante los viajes
  • Cualquier disputa entre usuarios

Nuestra responsabilidad total por cualquier reclamo derivado del Servicio no excederá $100.

15. Indemnización

Aceptas indemnizar y mantener indemne a TuRaite y sus funcionarios, directores, empleados y agentes de cualquier reclamo, daño, pérdida, responsabilidad y gasto derivado de tu uso del Servicio o violación de estos Términos.

16. Resolución de Disputas

16.1 Resolución Informal

Antes de presentar una disputa formal, aceptas contactarnos en [email protected] para intentar resolver la disputa informalmente.

16.2 Arbitraje

Cualquier disputa que no pueda resolverse informalmente se resolverá mediante arbitraje vinculante de acuerdo con las reglas de la Asociación Americana de Arbitraje. El arbitraje se llevará a cabo en el Condado de San Joaquín, California.

16.3 Renuncia a Demandas Colectivas

Aceptas resolver disputas con TuRaite de forma individual y renuncias a cualquier derecho de participar en demandas colectivas o arbitraje colectivo.

17. Ley Aplicable

Estos Términos se regirán por las leyes del Estado de California, sin tener en cuenta los principios de conflicto de leyes.

18. Cambios a los Términos

Podemos modificar estos Términos en cualquier momento. Te notificaremos de cambios materiales publicando los Términos actualizados y actualizando la fecha de "Última actualización". El uso continuado del Servicio después de los cambios constituye aceptación de los Términos modificados.

19. Disposiciones Generales

  • Divisibilidad: Si alguna disposición de estos Términos se considera inaplicable, las disposiciones restantes continuarán en vigor.
  • Renuncia: La falta de ejercicio de cualquier derecho o disposición no constituye una renuncia.
  • Cesión: No puedes ceder estos Términos sin nuestro consentimiento. Podemos ceder nuestros derechos libremente.
  • Acuerdo Completo: Estos Términos constituyen el acuerdo completo entre tú y TuRaite.
